By browsing through these Terms of Service and using the Services provided by our Platform (TSA Tekk), you agree to all Terms of Service along with the Privacy Notice on our Platform , which may be updated by us from time to time. Please check this page regularly to take notice of any changes we may have made to the Terms of Service. We reserve the right to review and withdraw or amend the Services without notice. We will not be liable if for any reason this Platform or parts thereof (website, mobile app) is unavailable at any time or for any period. From time to time, we may restrict access to some parts or this entire Platform .

By using this Platform , you agree to be bound by the Privacy Policy, and warrant that all data provided by you is accurate and up to date.

Our Platform provides links for sharing our content on third party websites such as Facebook, Instagram, or Twitter, health and nutrition platforms and such other social and digital media platforms. These are only for sharing and/or listing purpose and we take no responsibility of the third party websites, apps and/or their contents listed on our website TSA Tekk and disclaim all our liabilities arising out of any or all third party websites and apps.

We disclaim all liabilities and take no responsibility for the content that may be posted on such third-party websites by the users of such websites. We also disclaim all liability for all articles, blogposts and such other content relating to the use or performance of our Products by any individuals, posted by them on their blogs, social media accounts or other platforms. We advise you to verify the authenticity, compliance and information security measures of these websites, platforms, blogs etc, prior to sharing any information with them.

The Platform is an e-commerce platform that can be used by you to access informational content relating to health and nutrition and purchase protein supplements, dietary supplements and such other nutraceuticals hereinafter referred to as “Health Supplements/ Products”. The images of the Products on the Platform are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the Products.

Your Product’s appearance may vary slightly from those images. All colours and sizes of the Products and container of items are approximate; however we do make every effort to ensure they are accurate as possible. We take all reasonable care to ensure that all details, descriptions and prices of items are as accurate as possible.

The Products have usage instruction, health warnings and all related information regarding their consumption printed and displayed on the containers. The Products may be processed at facilities which process milk, soy, nuts and such other common allergens. All information, instructions and disclaimers on the Product containers are in accordance with FSSAI, FDI and all other relevant applicable rules, regulations and guidelines.

It is required that you use the Products in the same manner and you use them after consultation and recommendation by a medical practitioner and/or a qualified nutritionist. The Company shall be in no way liable for any adverse events including but not limited allergies, diseases or loss of life or limb that may arise out of non-prescribed or non-compliant use of the Products by you.

We reserve the right, at our sole discretion, to limit the quantity of items purchased per person, per household or per order. These restrictions may be applicable to orders placed by the same account, the same credit / debit card, and also to orders that use the same billing and/or shipping address. We will provide notification to the customer should such limits be applied. We also reserve the right, at our sole discretion, to prohibit sales to any one as we may deem fit.

We ensure that all details of prices appearing on the Platform are accurate, however errors may occur. If we discover an error in the price of any Products which you have ordered, we will inform you of this as soon as possible. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the Products, you will receive a full refund.

Additionally, prices for items may change from time to time without notice. However, these changes will not affect orders that have already been dispatched. The GST (or similar sales tax) at the prevailing rate shall be calculated at the check out and shall be collected by us, for which we are responsible as a seller. Please note that the prices listed on the Platform are only applicable for items purchased on the Platform and not through any other source.

Products will be dispatched only on acceptance of the order. The order will be accepted on receipt of all the payments by us. This Platform uses a trusted payment gateway for the purpose of processing any payments hereon. Howevevr, the payment gateway is a third party application/platform and this Platform is not liable for breach of data security, improper use, storage or unlawful dissemination of your information carried out by such payment gateway. We request you to review the terms and conditions of use of such payment gateway to better understand relevant provisions protecting your information.

You will be given various options for delivery of Products during the order process. The options available to you will vary depending on where you are ordering from. An estimated delivery time is displayed on the order summary page. On placing your order, you will receive an email containing a summary of the order and also the estimated delivery time to your location. Sometimes, delivery may take longer due to unforeseen circumstances. In such cases, we will proactively reach out to you by e-mail and SMS. However, we will not be able to compensate for any mental agony caused due to delay in delivery.

If you receive a Product, the container of which is unsealed or defective or a Product that is contaminated, you may ask for an exchange of the Product. Upon receiving sufficient proof from you about the defective container or contaminated Product, we will arrange for a return pick up of the Product. You are entitled to choose a similar Product or another Product of the same value, which shall be delivered to you within 15 days from the receipt of the faulty Product by us. In the event you do no wish not wish for an exchange, you may choose to receive a refund of the entire amount paid by you to us, within 15 working days of our receiving the defective Product.

The information contained on the Platform is provided for informational purposes only and is not meant to substitute for the advice provided by your doctor or other health care professional. The Company shall in no manner be held liable for any divergence in individual results or effects after consuming the Products.

All and any intellectual property rights in connection with the Products, the Platform and services there under, including but not limited to trademarks, copyrights, designs, patent and other registered and unregistered intellectual property rights associated with the Product, their composition and recipe, Product names, designs, container desings, logos, Platform names, taglines and any such other intellectual property, shall be owned absolutely by the Company. You shall have no right, license, title or interest in any such intellectual property rights.

These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Pune.

You agree to indemnify, defend and hold harmless the Company, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages or costs arising from your use of this Platform , your breach of these Terms of Service, or infringement of any intellectual property right.

You agree that the Company may, in its sole discretion and without prior notice, terminate your access to the Platform and block your future access if we determine that you have violated these Terms of Service or any other policies. If you or the Company terminates your use of any service, you shall still be liable to pay for any Products that you have already ordered till the time of such termination.
